1. Acceptance of Terms

By accessing and using the GritEstates website (www.gritestates.com), you acknowledge that you have read, understood, and agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree, you must discontinue use of the website immediately. These terms constitute a legally binding agreement between you and GritEstates. Where you are a consumer resident in the European Union or Portugal, mandatory consumer protection provisions of your country of residence apply in addition to these terms and shall take precedence to the extent of any conflict.

2. Nature of Services and Information

GritEstates provides real estate development, renovation, and property management services in Portugal. The information presented on this website is for general informational purposes only and does not constitute a binding offer, financial advice, or an invitation to invest. Property details, availability, pricing, and project timelines are subject to change without notice. Specific terms for any transaction will be set out in separate written contractual agreements signed by both parties. Nothing on this website constitutes a prospectus or regulated financial promotion.

3. Distance Contracts and Consumer Rights

Where a transaction concluded through this website constitutes a distance contract under Directive 2011/83/EU (transposed into Portuguese law by Decreto-Lei n.º 24/2014, as amended), the following provisions apply:

  • Right of withdrawal (14 days): Consumers have the right to withdraw from a distance contract within 14 calendar days without stating a reason, subject to the exceptions specified in Art. 17 of DL 24/2014 (e.g. real property contracts are excluded from the general withdrawal right under Art. 17(1)(l)).
  • Pre-contractual information: Before entering into any binding commitment, we will provide you with all mandatory pre-contractual information required by DL 24/2014 Art. 4 and Art. 8, including total price, identity of the trader, and the main characteristics of the service.
  • E-commerce information: In accordance with Decreto-Lei n.º 7/2004 (transposing EU Directive 2000/31/EC on electronic commerce), our company details are set out in the Imprint section of this website.

4. Intellectual Property

All content on this website, including but not limited to text, images, graphics, logos, icons, photographs, architectural renderings, and software, is the property of GritEstates or its licensors and is protected by Portuguese, EU, and international copyright, trademark, and intellectual property laws, including the Portuguese Código do Direito de Autor. No part of this website may be reproduced, distributed, modified, or used for commercial purposes without the prior written consent of GritEstates.

5. Limitation of Liability

GritEstates provides this website and its content on an "as is" basis without warranties of any kind, either express or implied. To the fullest extent permitted by applicable law, GritEstates shall not be liable for any direct, indirect, incidental, consequential, or special damages arising out of or in connection with your use of this website. Nothing in these terms excludes or limits liability that cannot be excluded or limited under mandatory provisions of Portuguese or EU consumer protection law, including liability for personal injury caused by negligence or for fraudulent misrepresentation.

6. Governing Law and Jurisdiction

These Terms of Use are governed by and construed in accordance with the laws of Portugal. For matters relating to properties and services in Portugal, Portuguese mandatory consumer and property law provisions, including Lei n.º 24/96 on consumer protection, apply where required. Any disputes arising out of or in connection with these terms shall be submitted to the competent courts in Portugal, unless mandatory consumer protection laws of your country of residence require the jurisdiction of another court.

7. Alternative Dispute Resolution

In accordance with EU Directive 2013/11/EU (transposed into Portuguese law by Lei n.º 144/2015) and Decreto-Lei n.º 24/2014 Art. 18, you have the right to use an Alternative Dispute Resolution (ADR) entity before resorting to courts. For disputes relating to our activities in Portugal, we acknowledge the following ADR entities:

8. Changes to These Terms

Your continued use of the website following any changes constitutes acceptance of the revised terms. We encourage you to review this page periodically to stay informed.
